Terms of Service - Elite Skills Canada (Elite English Canada Corp.)

1. Acceptance of Terms:

By purchasing and accessing the EnGen English language platform through Elite Skills Canada (Elite English Canada Corp.) ("we," "us," or "our"), you ("you" or "user") agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.  

2. Product Description and Presale Offer:

We are offering a presale for six (6) months of access to the EnGen English language learning platform for a discounted price of US$250. This is a limited-time offer and represents a significant discount from the original monthly price of US$100.

3. Payment Terms:

  • The presale price of US$250 is payable in full at the time of purchase.

  • Payment methods accepted are processed through Stripe.

  • This presale offer is non-refundable.

  • Users may cancel their access at any time, but no partial refunds will be provided for unused access.

  • The EnGen platform access is non-transferable.

4. Delivery:

Access to the EnGen English language platform is set to begin on May 2, [Year], subject to change at our discretion. However, access will be granted no later than August [Year]. If access is not granted by August [Year], a full refund will be issued.

5. Returns and Exchanges:

Due to the nature of the online access product, no returns or exchanges are offered.

6. Product Warranties:

We provide access to the EnGen platform "as is" and "as available." We make no warranties, express or implied, regarding the platform's performance, availability, or suitability for any particular purpose.

7. Disclaimers:

  • Educational Use Only: The EnGen platform is provided for educational purposes only. We do not guarantee any specific learning outcomes or language proficiency levels.

  • Third-Party Content: EnGen is a third-party platform. We are not responsible for the content, accuracy, or availability of the EnGen platform.

  • Technical Issues: We are not responsible for any technical issues or interruptions with the EnGen platform. Users should contact EnGen support for technical assistance.

  • No Professional Advice: Access to the EnGen platform does not constitute professional language training or advice. Users should seek professional guidance if necessary.

8. Intellectual Property Rights:

The EnGen platform and its content are the intellectual property of EnGen and are protected by applicable copyright and trademark laws. Users are granted a limited, non-exclusive, non-transferable license to access and use the platform for personal educational purposes only.  

9. Limitation of Liability:

  • To the maximum extent permitted by law, Elite Skills Canada (Elite English Canada Corp.) shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use of the EnGen platform.  

  • Our liability for any claim arising from these Terms of Service shall be limited to the amount you paid for the EnGen platform access.

  • We are not liable for any damages resulting from your inability to access or use the EnGen platform.

10. User Conduct:

Users agree to:

  • Use the EnGen platform for lawful and educational purposes only.

  • Not share their login credentials with others.

  • Not attempt to circumvent the platform's security measures.

  • Not engage in any activity that disrupts or interferes with the platform's operation.

  • Not use the platform for any commercial or unauthorized purposes.

  • Not upload or transmit any harmful or offensive content.

11. Governing Law and Dispute Resolution:

These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Alberta, Canada. Any disputes arising from these terms shall be resolved in the courts of Alberta, Canada.  

12. Termination of Accounts:

We reserve the right to terminate your access to the EnGen platform if you violate these Terms of Service. In cases of severe violation, no refunds will be given.

13. Privacy Policy:

14. Changes to Terms of Service:

We reserve the right to modify these Terms of Service at any time. Any changes will be posted on our website. Your continued use of the EnGen platform after such changes constitutes your acceptance of the new Terms of Service.
